Says Imo PDP Legal Adviser *Barr. Kissinger Ikeokwu*

Ihedioha administration set up a Judicial Panel of Enquiry to investigate wrong acquisition of lands and review lands taken over by previous administration without due process. Uzodinma inherited the Panel and allowed them to continue. The Panel was set up under the Imo State Judicial Panel of Enquires Law.

The Panel recieved Petitions by way of Memoranda from the general public and any interested party or group. They invited persons affected to come defend themselves. They concluded sitting and submitted their reports.

In line with the Imo Law on Judicial Panels of Enquires the State Executive Council deliberated on the Report and adopted same. The Report was Gazzeted and became a Supplimental Legislation and has force of law to be executed and implemented by Government.

All that an affected person can do is to 1. approach the Court for Judicial Review by way of An Order of Certiorari to quash the decision of the Panel if you think they did not give you fair hearing or that the process of the Panel did not follow due process as provided by the law setting it up and outlining it's procedures. 2. Proceed to Court with your title to seek declaration restoring your title by enforcing your Allocation, Fees paid up to date, Building approvals and to seek damages against trespass or any excesses if government. Our Laws have a larger room for remedies.

It is not the duty of any citizen to challenge or stop the government from implementing any policy or decision. Remember the land is first of all an Imo State Government land allegedly allocated to a private citizen.

If Imo State Government allocated Land to you and same Imo State Government revoked same allocation, seal it, take it over etc, without due process assuming, just go to Court. Prove that the allocation was regular. Prove the fees you paid to regularize and other fees for improvements and approvals for the type of building. Once you prove it our Courts will remedy your injury because that will mean estoppel.

Unless you are afraid your title is not regular.
